These Terms of Service ("Terms") govern your access to and use of the website nordlyshaircare.com (the "Site") and any purchase of products from Nordlys ("we", "us", "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or place an order.


2. Eligibility

You may only purchase from the Site if you are at least 18 years old and legally capable of entering into a binding contract in your country of residence. By placing an order, you confirm that this is the case.


3. Products

3.1 Cosmetic products

All Nordlys products are cosmetic products intended for external topical use on the scalp and hair. They are not medicines, drugs, or medical devices. They are not intended to diagnose, treat, cure, or prevent any disease or condition, including hair loss.

3.2 Ingredients and claims

We describe our ingredients and the published research behind them honestly and in detail. Where we reference clinical studies, those studies relate to specific ingredients in specific contexts. Individual results from using Nordlys products will vary based on hair type, scalp condition, age, genetics, diet, lifestyle, and consistency of use. We make no guarantee that any individual user will experience any specific outcome.

3.3 Allergies and sensitivities

Our products contain plant-derived essential oils (including rosemary and lavender), fish-derived ingredients, and oat-derived ingredients. If you have known allergies or sensitivities to any of these ingredients, do not use the products. We recommend a patch test before first use. Discontinue use and consult a healthcare professional if irritation occurs.

3.4 Pregnancy and medical conditions

Rosemary essential oil is not recommended for use during pregnancy or breastfeeding. If you are pregnant, breastfeeding, or under medical care, consult your doctor before using Nordlys products.


4. Orders and Contract Formation

4.1 Placing an order

When you place an order on the Site, you make an offer to purchase the products at the prices and on the terms listed. We will send you an order acknowledgement by email confirming we have received your order. This acknowledgement does not form a contract between us.

4.2 Acceptance

A binding contract is formed only when we send you a separate shipping confirmation email confirming the products have been dispatched. Until that point, we may decline or cancel your order for any reason, including (without limitation) stock unavailability, pricing errors, suspected fraud, or inability to ship to your delivery address.

4.3 Pricing errors

Despite our efforts, products on the Site may occasionally be mispriced. If we discover a pricing error after you place an order, we will contact you to confirm whether you wish to proceed at the corrected price or cancel the order. If we cannot reach you, we will treat the order as cancelled and refund any payment in full.


5. Pricing, Taxes, and Payment

5.1 Currency and prices

Prices are displayed on the Site in the currency selected at checkout (EUR, GBP, USD, CAD, AUD, or NZD as applicable). Prices may change at any time, but changes do not affect orders we have already accepted under section 4.2.

5.2 Taxes and duties

For orders shipped within the EU, prices include applicable VAT unless stated otherwise.

For orders shipped to the United Kingdom, United States, Canada, Australia, or New Zealand, prices may be displayed exclusive of local taxes, customs duties, and import fees. You are responsible for any such taxes, duties, or fees imposed by the destination country, unless we have explicitly included them at checkout (e.g., DDP — delivered duty paid). We will indicate at checkout whether duties are included.

5.3 Payment

We accept the payment methods displayed at checkout. Payment is taken at the time of order. By submitting payment information, you confirm that you are authorised to use the payment method and that the information you provide is accurate.


6. Shipping and Delivery

6.1 Where we ship

We ship to the United States, Canada, Australia, the United Kingdom, New Zealand, and Belgium / EU member states. Available destinations and shipping options are confirmed at checkout.

6.2 Delivery times

Estimated delivery times are shown at checkout and are estimates only. We are not liable for delays caused by carriers, customs, weather, or other circumstances outside our reasonable control.

6.3 Risk and title

Risk of loss and damage to the products passes to you when the products are delivered to the address you provided. Title to the products passes to you once we have received full payment.

6.4 Customs and import

For international shipments outside the EU, the recipient is the importer of record and is responsible for compliance with all import laws and regulations of the destination country, including any required declarations.


7. Cancellation and Returns

7.1 EU and UK statutory withdrawal right

If you are a consumer resident in the European Union or the United Kingdom, you have the right to withdraw from your purchase contract within 14 days of receiving the products, without giving any reason. To exercise this right, you must inform us by email at support@nordlyshaircare.com before the 14-day period expires.

You must return the products to us within 14 days of notifying us of your withdrawal. You bear the cost of return shipping. We will refund the price you paid for the products and the standard cost of outbound delivery within 14 days of receiving the returned products (or proof of return shipment, whichever is earlier), using the same payment method you used for the order.

Exception: Sealed cosmetic products that have been unsealed after delivery are excluded from the right of withdrawal for hygiene reasons under Article VI.53.5° of the Belgian Code of Economic Law (implementing the EU Consumer Rights Directive). Once a Nordlys product has been opened, it cannot be returned for a refund unless it is faulty.

7.2 Voluntary returns policy (all customers)

In addition to any statutory rights, we offer the following voluntary returns policy to all customers, including those in the US, Canada, Australia, and New Zealand:

  • Unopened, unused products may be returned within 90 days of delivery for a full refund of the product price (excluding shipping costs).
  • The customer is responsible for return shipping costs.
  • Products must be returned in their original packaging, with all seals intact.

7.3 Faulty or incorrect products

If a product arrives damaged, faulty, or different from what you ordered, contact us at support@nordlyshaircare.com within 14 days of delivery with your order number and photos. We will arrange a replacement or full refund (including return shipping costs) at no cost to you. This does not affect any statutory rights you have under the law of your country of residence.


8. Subscriptions and Auto-Replenishment

8.1 How subscriptions work

If you choose to subscribe to a Nordlys product (auto-replenishment), you authorise us to charge your payment method on the schedule you select at checkout (for example, every 30, 60, or 90 days) until you cancel. The applicable price, frequency, and next billing date are shown to you before you confirm the subscription and in your account dashboard at all times.

8.2 Price changes

We may change subscription prices. If we do, we will notify you by email at least 30 days before the new price takes effect. You may cancel your subscription at any time before the new price applies if you do not wish to continue.

8.3 Cancellation

You can cancel your subscription at any time, for any reason. There is no minimum commitment. To cancel:

  • Log in to your account on the Site and cancel from your subscription dashboard, or
  • Email support@nordlyshaircare.com with your order number and a request to cancel.

Cancellations made at least 48 hours before the next scheduled charge will prevent that charge. Cancellations made within 48 hours of a scheduled charge may not stop that charge, but will stop all future charges.

8.4 Refunds for subscription orders

The cancellation, returns, and statutory withdrawal rights in section 7 apply to subscription orders in the same way they apply to one-time purchases.


9. Use of the Site

9.1 Permitted use

You may use the Site for lawful, personal purposes only — to browse products, place orders, manage your account, and communicate with us.

9.2 Prohibited conduct

You must not:

  • Use the Site in any way that breaches any applicable law or regulation;
  • Use the Site to transmit malware, viruses, or any harmful code;
  • Attempt to gain unauthorised access to the Site, our servers, or any account that is not yours;
  • Scrape, copy, or systematically extract content from the Site without our written permission;
  • Use the Site to harass, defame, or harm any other person;
  • Place fraudulent orders or use stolen payment information.

We may suspend or terminate your access to the Site or your account if we reasonably believe you have breached these Terms.

9.3 Account security

If you create an account, you are responsible for keeping your password confidential and for all activity under your account. Notify us immediately at support@nordlyshaircare.com if you suspect unauthorised use.


10. Intellectual Property

All content on the Site — including the Nordlys name, logo, product names (Grøde, Rense, Gulldråpe), copy, photography, illustrations, and design — is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may view and print pages from the Site for personal, non-commercial use. You may not reproduce, distribute, modify, or use any content for commercial purposes without our prior written consent.

User-generated content (e.g., reviews you submit) remains yours, but by submitting it you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display it in connection with the Site and our marketing.


11. Limitation of Liability

11.1 Nothing excluded

Nothing in these Terms limits or excludes our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • defective products under the EU Product Liability Directive or equivalent UK, US, Canadian, Australian, or New Zealand product liability laws;
  • any other liability that cannot be limited or excluded under applicable law.

11.2 Otherwise

Subject to section 11.1, our total liability to you for any claim arising out of or related to these Terms or your use of the Site or our products is limited to the amount you paid for the products that gave rise to the claim.

We are not liable for indirect, consequential, or special losses, including loss of profits, loss of business, or loss of data, except where such liability cannot be excluded under applicable law.

11.3 Consumer rights preserved

If you are a consumer, your statutory rights under the laws of your country of residence are not affected by these Terms.


12. Privacy

We process personal data in accordance with our Privacy Policy which forms part of these Terms. Our processing complies with the EU General Data Protection Regulation (GDPR), the UK GDPR, and applicable privacy laws in the US, Canada, Australia, and New Zealand.


13. Force Majeure

We are not liable for any failure or delay in performing our obligations under these Terms caused by circumstances beyond our reasonable control, including natural disasters, war, civil unrest, pandemics, government action, carrier failures, or supplier shortages.


14. Changes to These Terms

We may update these Terms from time to time. The version in force at the time you place an order is the version that governs that order. The current version is always available on the Site, with the "Last updated" date at the top.

For ongoing subscriptions, material changes to these Terms will be communicated to you by email at least 30 days before they take effect, and you may cancel before then if you do not agree.


15. Governing Law and Jurisdiction

15.1 Governing law

These Terms and any contract for the sale of products between us are governed by the laws of Belgium, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

15.2 Jurisdiction

The courts of Brussels, Belgium have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms.

15.3 Mandatory consumer protection

If you are a consumer, the choice of law and jurisdiction above does not deprive you of the protection of the mandatory consumer protection laws of your country of residence. EU consumers may also bring proceedings in the courts of their EU member state of residence under Article 18 of Regulation (EU) No 1215/2012.

15.4 EU Online Dispute Resolution

EU consumers may use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr to resolve disputes out of court. Our contact email for ODR is support@nordlyshaircare.com.


16. Miscellaneous

  • Entire agreement. These Terms (together with our Privacy Policy and any policies referenced in them) form the entire agreement between you and us in relation to your use of the Site and any purchase of products.
  • Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force.
  • No waiver. Our failure to enforce any provision of these Terms does not waive our right to enforce it later.
  • No assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations to any successor entity.
  • Language. These Terms are concluded in English. If we provide a translation, the English version prevails in the event of any inconsistency.
